Florida Statutes, Section 117.021 - Electronic Notarization
The Florida Legislature has recently enacted a law, effective January 1, 2008, providing requirements for electronic notarization (click here to read the new law in its entirety). As the electronic age continues to advance and grow, so does the ability to use technology versus the traditional paper-and-pen notarization. In the next few years, the use of e-notarization is expected to grow.
Although this new statute has been passed, no standards or practices for handling electronic documents are yet in place in Florida. Only a handful of e-notarizations have taken place across the entire country. The Florida Department of State continues to research the best options for an electronic notarization process. When a final decision is made by the Secretary of State, we will post any updates on our website.
